ACKNOWLEDGEMENT, UNDERTAKING AND INDEMNITY: BMW DRIVING EXPERIENCE

1. I warrant that I will not drive the motor vehicle without being in possession of a current and valid license for the driving of such motor vehicle, and further that I will adhere to all legislation pertaining to the driving of such motor vehicle at all times.
2. I warrant that I am in good health and that I do not suffer from any illness or disability which may make it unsafe to drive any motor vehicle.
3. I warrant that I will not permit any other person to drive the motor vehicle without the prior written approval of BMW. I further warrant that all persons driving the vehicle will have the necessary permits and/or licenses required by applicable legislation, including but not limited to Public Driver’s Permits and valid driver’s licenses required for transporting passengers.
4. I acknowledge and warrant that I will be solely liable for all fines or penalties imposed as a result of any traffic violations or statutory offences whilst the vehicle is driven by me and/or in my possession. I hereby indemnify BMW in this regard.
5. I acknowledge and understand that, in the event of me having consumed any intoxicating substance(s) or exhibiting any unacceptable or unreasonable behavior, BMW may, in its sole discretion, exclude me from participating in the course.
6. I acknowledge and agree that my personal information is required for the purposes of this driving experience and will not be disclosed to any unauthorised party. I consent to the processing of my information in accordance with prevailing legislation. This includes, but is not limited to, the sharing of my information with BMW Group entities, approved BMW Group retailers and repair centres, agencies, suppliers, government authorities, and the trans-border flow of such information where necessary.
7. I hereby indemnify and hold BMW, any BMW employee and/or any agent, service provider or supplier engaged by BMW for purposes of the driving experience, and/or the owner/landlord of the property on which the driving experience is presented, harmless against all liabilities, claims, losses, and damages of whatsoever nature, which the aforementioned persons, entities, and/or any other person may sustain as a direct result of me driving the vehicle. This includes claims, losses and damages caused by my negligent or willful act or omission, including but not limited to breaches of the warranties contained in clauses 1, 2, 3, or 4 above.
8. Accordingly, BMW, any BMW employee and/or any agent, service provider or supplier engaged by BMW for purposes of the course, and/or the owner/landlord of the property on which the course is presented, shall not be liable for any loss, damage and/or injury of whatsoever nature and howsoever caused, suffered by me (to my person or property) as a direct result of me driving the vehicle. The aforementioned persons and/or entities shall not be liable for any loss and/or damage (including indirect or consequential loss and/or damage) arising therefrom.
9. I undertake and acknowledge that I will be liable for an excess of R7 500.00 should the motor vehicle be the subject of an insured event, caused by my negligent or willful act or omission. This includes, but is not limited to, any accident damage or theft.

I confirm that the provisions of these clauses have been drawn to my attention, explained, and have been accepted by me.
